Dog Attack……AGAIN!

This latest dog attack was not a Pit Bull but it still left a four year old Texas boy dead.  It was a mixed breed and we may never know what kind of dog it was.  The owners say it was not an aggressive dog but I find it hard to believe this dog had never shown any aggression after what it did to this little boy in Texas. However, some breeds are known to “flip a switch” and attack even when they have not done so before.  Always be careful with dogs and kids.  This is such a sad case:  Click here for the link.

One thing people don’t know is that dog does not have to be “vicious” for the owner to be liable.  If a dog is simply “rambunctious or overly playful” and causes an injury, the owner can be liable.  Imagine an elderly person being knocked down by a smaller breed dog that is jumping on them trying to play If the owner had witnessed this behavior before, they could be held liable, for example, a broken hip or other broken bone. There are few things that make me angrier than vicious dog attacks and dog bites that could have been prevented.  This is especially true when there is a child victim!  The reckless disregard this Pit Bull Owner showed his neighbors is inexcusable!

I hope and pray that the owner has enough insurance to cover this young man’s injuries because he appears to have a hell of a lawsuit!  The lawyer they hire will have to prove that the owner knew or should have known that the dog was dangerous and failed to prevent the attack.  Since the dog has allegedly attacked before, this should be easy for the attorney to prove.
